To all whom it may concern: Be it known that we, BRUMMEL & MEN- DELSOHN, a lirm domiciled in the cit of New York, county of New York, and State of New York, doing business at 515 Broad- way, in said city, and composed of the fol- lowinof members, EBIANUEL BRUDIBIEL, AL- FRED tBRUM}IEL, ARTHUR C. MnNDnLsoHN, and Louis MENDELSOHN, all citizens of the United States, have adopted and used the trade-mark shown in the accompanying drawing, for hosiery, underwear, and knitted sweaters, in Class 39, Clothing. The trade-mark has been continuously used in our business since January, 1895. The trade-mark is aflixed or applied to the goods and packages, boxes, or other recep- tacles containing the same by placing there- on a label on which the mark is shown. MENDELSOHN being duly sworn deposes and says that he is a member of the firm, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said firm is the owner of the trade-mark sought to be registered; that no other person, firm, cor- poration or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark is used by said firm in commerce among the several States of the United States, and between the United States and foreign nations; that the description and drawing presented truly represent the trade-mark sought to be regis- tered; and that the facsimiles show the trade-mark as actually used upon the goods.
