Application i1ed'February 12, 1921. Serial No. 143,502. STATEMENT. To all whom it may concern: Be it known that we, E. I{ESSLING THER- MOMETER Co., a firm domiciled in the city of New York, borou h of Brooliéyn, in the county of Kings and State of ew York, and located and doing business at 96 Suydam' street, in said city and borough, and com- osed of the following members, EDWARD EYESSLING and EDWVARD Knssnmc, Jr., citi- zens of the United States, have adopted and used the trade-mark shown in the accom- panying drawing, consisting of the word “ Kesek,” for clinical thermometers, in Class 26, Measuring and scientific appliances. The trade mark has been continuously used in our business since about 1901. The trade mark is applied to the goods by engraving thereon, or is printed on the boxes containing the goods. E. EDNVARD KESSLING, Jr., being duly sworn, deposes and says that he is a member of the iirm, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said firm is the owner of the trade-mark sought to be registered; that no other person, firm, cor- poration or association, to the best of his knowledge and belief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark is used by said firm in commerce among the several States of the United States, and between the United States and foreign nations, and particularly with Vene- zuela, Cuba, Mexico, & Canada; that the drawing presented truly represents the trade- mark sought to be registered; and that the specimens show the trade-mark as actually used upon the goods.
