RICH, FREDERICK A. FLOOD, and HARRY L. J ONES, citizens of the United States of America, have adopted for our use the trade-mark 'shown in the accompanying drawing, for coffee, in Class 46, Foods and ingredients of foods. No claim is made for the word “Brand” apart from the other features of the trade mark shown in the drawing. The trade mark has been continuously used in our business since June 25, 1906. The trade mark is applied to the recepta- cles containing the goods by printing the mark directly thereon, or by placing thereon a printed label on which the trade mark is shown. FLOOD, being duly sworn, deposes and says that he is a member of the firm of CHASE & SANBORN, the applicant named in the foregoing statement; that he believes said statement is true; that he be- lieves said firm to be the owner of the trade mark sought to be registered; that no other person, firm, corporation, or association, to the best of his knowledge and belief, has the right to use said mark, either in the identical form or in any such near resem- blance thereto as might be calculated to deceive; that said mark is used by said firm in commerce among the several States of the United States; that the drawing pre- sented truly represents the mark sought to be registered; and that the specimens show the mark as actually used upon the goods.
