Serial No. 139,567. _ ` J STATEMENT. , To all whom it may concern' _ Be it _known that COMMERCIAL UNION or AMERICA, INCORPORATED, a corporation duly organized under the laws of the State of New York, and located in the city of New York, county and State of New York, and doing business at23-25 Beaver street, in said city, county, and State of New York, has adopted and used the trade-mark shown in the accompanying drawing, for wheat- Hour, in Class No. 46, Foods and ingredients of foods. 4: The trade-mark has been continuously used in the business of said corporation since Au- gust 20, 1920. MITROU, being duly sworn, deposes and says that he is the secretary and treasurer of the corporation, the applicant named in the foregoing statement; that he believes the foregoing 'statement is true; that he believes said corporation is the owner of the trade-mark sought to be registered; that no other person, firm, corporation, or asso- ciation, to the best of his knowledge and be- lief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance there- to as might be calculated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States and between the United States and foreign nations and particularly with Spain, Belgium, Algeria, Greece and Tur- key; that the description and drawing pre- sented truly represent the trade-mark sought to be registered; and that the facsimiles show the trade-mark as actually used upon the goods.
