HALL & COM- PANY, a firm located and doing business at Ottumwa, in tl1e county of Wapello, in the State of Iowa, and composed of the follow- ing members, WVALTER T. HALL and X/VILLIAM S. VINSON, has heretofore adopted and used the trade-mark shown in the accompanying drawing, for candy, in Class 46, Foods and ingredients of foods. The trade-mark has been continuously used in applicants business and in the busi- ness of their predecessors since Dec. 1918. The applicant is the owner of registration No. 138016, December 14, 1920. The trade-mark is applied or afiixed to the goods by means of labels bearing this trade mark or by printing or impressing the sa-me directly on the goods and in divers other ways. ' WALTER T. VINSON, being duly sworn, deposes and says he is tl1e member of the firm of XVALTER T. HALL & COBIPANY, the applicant named in the foregoing statement; that he believes that the foregoing statement is true; that he believes said firm to be the owner of the trade-mark sought to be regis- tered; that no other person, firm, corpora- tion or association, to the best of his knowl- edge or belief, has a right to use said trade- mark, either in the identical form, or in any such near resemblance thereto as might be calculated to deceive ; that the said trade-mark is used by the applicant in commerceramong the several States of the United States; that the drawing presented truly represents the trade-mark sought to be registered and that the specimens show the trade-mark as actually used upon the goods.
