Application filed December 21, 1920. Serial No. 141,388. STATEMENT. To a-ZZ w hom it may coowem : Be it known that PRIMALT PRODUCTS COM- PANY, a corporation duly organized under the laws of the State of Illinois, and located in the city of Chicago, county of Cook, in the State of Illinois, and doing business at No. 825 Blackhawk street, in the city of Chi- cago, in the State of Illinois, has adopted and used the trade-mark shown in the ac- companying drawing. The particular description of goods to which said trademark is appropriated is ginger-ale, in Class 45, Beverages, non-alco- holic. _ The trademark has been used continuously in the business of the applicant since July 1, 1919. The trade-mark is applied or afiixed to the goods, or to the packages containing the same by placing thereon printed labels on which the trade-mark is shown. PRIMALT PRODUCTS COMPANY. JOHN LAUGHLIN F1'rzsIMoNs being duly sworn deposes and says that he is the secre- tary of the corporation the applicant named in the foregoing statement; that he verily believes that the foregoing statement is true; that he believes said corporation is the owner of the trade-mark sought to be registered, that no other person, firm, corporation or association to the best of his knowledge and belief has the right 'to use said trade-mark in the United States, either in the identical form or in such near resemblance thereto as might be` calculated to deceive; that such trade-mark is used by said corporation in commerce among the several States of the United States and that the description and drawing presented truly represent the trade- mark sought to be registered and the speci- mens (or facsimiles) show the trade-mark as actually used upon the goods.
