SEXAUER & SON, a corporation duly organized under the laws of the State of South Dakota, and located in Brookings, in the county of Brookings and State of South Dakota, and doing business in saidcity, has adopted and used the trade-mark shown in the accom- panying drawing, for seeds for food pur- poses and poultry feeds, in Glass 46, Foods and ingredients of foods. The trade-mark has been continuously used by the corporation in its business since about April 1, 1920. _ The mark is applied to the goods by the use of printed labels which are affixed to the boxes, packages, or other containers, con- taining the goods.; _‘ GEO. SEXAUER, being duly sworn, deposes and says that he is the secretary-treasurer of the corporation, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said corporation is the owner of the trade- mark sought to be registered; that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States of America, on merchandise of the same descriptive properties as those recited in the foregoing statement; that said mark is used by saidvcorporation in com- merce among the several States of the United States; _that the description and drawing presented truly represent the mark sought to be registered; .that the specimens show the mark as actually used upon the goods; and that the mark has been in bona fide use for not less than one year in inter- state commerce by said corporation or its predecessors in business.
