To all whom it may conoem : Be it known that we, FINE. & LEVY, a firm domiciled in the city of New York, borough of Manhattan, county and State of New York, and doing business at 696-702 Broad- way, in said city and borough, and composed of the following members, SAMUEL FINE. and HARRY Gr. LEVY, citizens of the United States, have adopted and used the trade- mark shown in the accompanying drawing, for men’s and boys’ hats and caps, in Class 39, Clothing. The trademark has been continuously used in our business since July lst, 1920. The trademark is applied or atlixed to the goods by stamping the same directly upon the sweat bands thereof or by stamping di- rectly upon the lining. FINE & LEVY, _ By HARRY G. LEVY, Partner. Y., ss: SAMUEL FINE, being duly sworn, deposes and says, that he is a member of the iirm, the- applicant named in_the above entitled application; that he believes the statement forming a part of the above entitled applica- tion is true; that he believes said lirm is the owner of the trade mark sought to be regis- tered; that no other person, firm, corpora- tion or association, to the best of his knowl- edge and belief, has the right to use said trade mark in the United States of America on merchandise of the same descriptive properties as those recited in the statement in the above-entitled application; that the said mark is used by said firm in commerce among the several States of the United States; that the description and drawing presented truly_ represent the mark sought to be registered; that the specimens show the mark as actually used upon the goods; and that the mark has been in bona. #cle use for not less than one year in interstate com- merce by the applicant.
