Be it known that Covnnr GEAR COMPANY, a corporation duly organized under the laws of the State of New York, and located in the city of Lockport, county of Niagara, in said State, and doinfr business at Lockport, in said county and §tate of New York, has adopted and used the trade-mark shown in the accompanying drawing, for transmis- sion-gearing and parts thereof, in Class No. 23, Cutlery, machinery, and tools, and parts thereof. The trade-mark has been continuously used in the business of said corporation since 1910. The trade-mark is applied or affixed by casting same directly on the gear cases, and by stenciling same on the shipping cases. COVERT GEAR COMPANY, By ALWVIN A. GLOETZNER, President. V DECLARATION. State of New York, county of Niagara, ss. ALWIN A. Gnonrzman, being duly sworn, deposes and says that he is the president of the corporation, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said corporation is the owner of the trade- mark sought to be registered; that no other person, firm, corporation, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade- mark is used by said corporation in com- merce among the several States of the United States (and between the United States and foreign nations and particularly with England, Sweden, India, Australia, South Africa, and France); that the de- scription and drawing presented truly rep- resent the trade-mark sought to be regis- tered; and that the specimens show the trade-mark as actually used upon the goods.
