Be it known that the JERSEYVILLE NUR- sERY, a corporation duly organized and ex- isting under and by virtue of the laws of the State of Illinois, and located in Dow, in the county of Jersey and State of Illinois, and doing business at Dow, Illinois, and J er- seyville, Illinois, has adopted and used the trade-mark shown in the accompanying drawing, no claim being made to the exclu- sive use of the words “The Apple” nor to the representation of the fruit tree and the fruit thereon apart from the mark as shown on the drawing, for fruit-trees, in Class 1, Raw or partly-prepared materials. The trade mark has been continuously used in the business of said corporation since February 4, 1921. The trade mark is aiiixed to the oods by attaching thereto tags on which tie trade mark is shown. HARRY WELLINGTON SHAFER, being duly sworn, deposes and says that he is the presi- dent of the corporation, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he be- lieves said corporation is the owner of the trade-mark sought to be registered; that no other person, firm, corporation or associa- tion, to the best of of his knowledge and be- lief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be cal- culated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the drawing presented truly represents the trade-mark sought to be registered; and that the specimens show the trade-mark as actu- ally used upon the goods.
