STATEMENT. ` Y/ ~ Be it known that we, PHonL & SCHALLER, a firm domiciled in the city of New York, borough of Manhattan, in the county and State of New York, doing business at 71 Nassau street, New York city, and composed of the following members, CONRAD PHOEL and PHILIP PHOEL, both citizens of Hol- land, and FRANK SCIIALLER, a citizen of the United States, have adopted and used the trade-mark showin in the aiccompanying drawings, for finger-rings and other articles watches, in Class No. 28, Jewelry and pre- cious-metal ware. The trade-mark has been continuously used in our business since about February 21st, 1921. The trade-mark is applied by being print- ed or stamped on the lining of the boxes in which the goods are sold and shipped. PHOEL & SCHALLER, By PHILIP PHOEL, H A Member of the Firm. DECLARATION. State of New York, county of New York, ss: PHILIP PHOEL, being duly sworn, deposes and says that he is a member of the firm, the applicant named in the .foregoing state- ment; that he believes the foregoing state- ment is true; that he believes said firm is the owner of 'the trade-mark sought tobe reg- istered; that no other person, firm, cor- poration, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near re- semblance thereto as might be calculated to deceive; that said trade-mark is used by said firm in commerce among the several States of the United States; that thede- scription and drawing presented truly rep- resent the trade-mark sought to be reg- istered, and that the specimens show the trade-mark as actually used upon the goods.
