The particular description of goods to which said trademark is appropriated is pf, . ,. hoisery for men, women, and children, in Class 39, Clothing. The trademark has been used continuously in the business of the applicant since Febru- ary 2, 1921. The trade-mark is applied or affixed to the goods, or to the packages containing the same by placing thereon printed labels upon which the trade-mark isshown. HARRY ZEITEL being duly sworn deposes and says that he is a member of the firm, the applicant named in the foregoing state- ment; that he verily believes that the fore- going statement is true; that he believes the said firm is the owner of the trade-mark sought to be registered, that no other per- son, iirm, corporation or association to the best of his knowledge and belief has the right to use said trade-mark in the United States, either in the identical form or in such near resemblance thereto as might be calcu- lated to deceive; that such trade-mark is used by the applicant in commerce among the several States of the United States and that the description and drawing presented truly represent the trade-mark sought to be registered and the specimens (or facsimiles) show the trade-mark as actually used upon the goods.
