To all whom it may concern: Be it known that SEARS, ROEBUCK AND Co., a corporation duly organized under the laws of the State of New York, located in the city of Chicago, county of Cook, State of Illinois, and doing business at the corner of I-Ioman avenue and Arthington street, in said city of Chicago, has heretofore adopted and used the trade-mark shown in the ac- companying drawing for chambray in the in Class No. 42, Knitted, netted, and textile fabrics. The trade mark has been continuously used in its business since September 24, 1920. LOEB, being duly sworn, de- poses and says that he is vice-president of SEARS, ROEBUCK AND Co., the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said corporation is the owner .of the trade-mark sought to be registered; that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be calcu- lated to deceive; that the said trade-mark is used by said corporation in commerce among the several States of the United States; that the drawing presented truly represents the trade-mark sought to be reg- istered, and that the specimens show the trade-mark as actually used upon the goods.
