To all whom it may concern: Be it known that THE SOUTHWESTERN MILLING COMPANY, INC., a corporation duly organized under the laws of the State of New York, and located in the city, county, and State of New York, and doing busi- ness at No. 49 Wall street, in the city, county, and State of New York, has adopted and used the trade-mark shown in the accom- panying drawing, for wheat-flour, in Class No. 46, Foods and ingredients of foods. The trademark has been continuously used in the business of said corporation since De- cember 9, 1919. The trademark is applied or affixed to the goods or to the packages containing the same by applying the trademark directly on the flour sacks. [L. s.] THE SOUTHWESTERN MILL- ING COMPANY, INC., By J. NEVILLE, being duly sworn, deposes and says he is the secretary of THE SOUTH- WESTERN MILLING COMPANY, INC., the appli- cant named in the foregoing statement; that deponent believes the foregoing statement is true; that deponent believes said ap- plicant is the owner of the trademark sought to be registered; that no other per- son, firm, corporation or association, to the best of deponent’s knowledge and belief, has the right to use said trademark, either in the identical form or in such near resemblance thereto as might be calculated to deceive; that said trademark has been used by said corporation in commerce among the several States of the United States; that the descrip- tion, drawings and facsimiles presented truly represent the trademark sought to be regis- tered; that the specimens show the trade- mark as actually used upon the goods and that the mark has been in a bona ficle use for less than one year by the applicant or its predecessors in business.
