Be it known that EASTERN TUBE & TOOL COMPANY, INC., a corporation organized and existing under the laws of the State of New York, and located and doing business at No. 594 Johnson avenue, in the borough of Brooklyn, county of Kings, and State of New York, has adopted and used the trade- mark shown in the accompanying drawing, for armored conductors and flexible steel conduits, in Class 21, Electrical apparatus, machines, and supplies, “Steel” being dis- claimed apart from the mark as shown. The trade-mark has been continuously used in the business of said corporation since No- vember 8, 1920. The trade-mark is applied to the goods by attaching a label to the package containing the article, or by marking the name on the article itself, or both. SCHNEIDER, being duly sworn, deposes and says that he is the secretary of the EASTERN TUBE & TOOL COMPANY, INC., the applicant named in the foregoing state- ment; that he believes the foregoing state- ment is true;,that he believes said corpora- tion is the owner of the trade mark sought to be registered; that no other person, firm, corporation or association to the best of his knowledge and belief has the right to use such trade mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the trade mark sought to be reg- istered; and that the specimens show the trade mark as actually used upon the goods.
