ING., a corporation duly organized under the laws of the State of New York, and located in the city of New York, county of New York, in said State, doing business at No. 15 Union Square, in the city of New York, county of New York, and State of New York, has adopted and used the trade-mark shown in the accompanying drawings, for dolls, in Class 22, Games, toys, and sporting goods. The trade mark has been continuously used in the business of said corporation since the 29th day of Oct., 1920. The trade mark is applied or affixed to the packages containing 'the same by placing thereon a printed label on which the trade mark is shown or printing facsimiles thereof, thereon, or sewing tags on the doll. HORSMAN, being duly sworn, deposes and says that he is the president of the E. I. HORSMAN & AETNA DOLL Co. INC., the applicant named in the foregoing state- ment; that he believes the foregoing state- ment is true; that he believes said corpora- tion is the owner of the trade mark sought to be registered; that no other person, irm, corporation or association to the best of his knowledge and belief has the right to use said trade mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade mark is used by said corporation in commerce among the several States of the United States, and that the description, drawing and facsimiles pre- sented truly represent the trade mark sought to be registered; and that the facsimiles show the trade mark as actually used upon the goods.
