To all w/tom it may concern : 'Be it known that we, il/VALTON HOSIERY MILLS, a iirm domiciled in Statesville, county of Iredell, State of North Carolina, located and doing business at Fourth and Wise streets, in said city, and composed of the following members, J oHN IVALTON, Sr., JoHN WALTON, Jr., and ELXVOOD W. VVAL- TON, citizens of the United States of America, have adopted and used the trade- mark shown in the accompanying drawing, for ladies’ and child_ren’s cotton, wool, and silk hosiery, in Class No. 39, Clothing. The trade-mark has been continuously used in our business since July, 1920. The trade-mark is applied or aiiixed to the goods, or to the packages containing the same, by means of a label on which the trade-ma.rk is shown, or by means of a rider ticket, or by means of a sticker. State of North Carolina, county of Ire- dell, ss: J OHN WALTON, Jr., being duly sworn, deposes and says that he is a member of the firm the applicant named in the fore- going statement; that he believes the fore- going statement is true; that he believes said firm is the owner of the trade-mark sought to be registered; that no other per- son, iirm, corporation, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade- mark is used by said firm in commerce among the several States oif the United States; that the description and drawing presented truly represent the trade-mark sought to be registered; and that the fac- similes show the trade-mark as actually used upon the goods.
