To all whom it may concerm Be it known that THE COLE PUBLISHING COMPANY, a corporation duly organized and existing under the laws of the State of Ohio, located in the city of Cleveland, county of Cuyahoga, in said State, and doing_business at 21st street and Payne avenue, in said city, has adopted and used the trade-mark shown in the accompanying drawing, on a publica- tion issued weekly, in Class 38, Prints and publications. The trade-mark has been continuously used in the business of said corporation in its present form since January, 1921, and the title “Ohio Motion Picture Review” form- ing part of said trade-mark has been in use since February, 1919. The trade-mark is applied or affixed to the goods by being printed or otherwise im- pressed upon the front cover page of each publication. THE COLE PUBLISHING COMPANY, By GEO. R. COLE, President. COLE, being duly sworn, deposes and says that he is the president of the corpora- tion, the applicant named in the foregoing statement signed by him; that he believes the foregoing statement is true; that he be- lieves said corporation is the owner of the trade-mark sought to be registered; that no other person, firm, corporation or associa- tion, to the best of his knowledge and belief, has the right to usesaid trade-mark in the United States, either in the identical form. or in any such near resemblance thereto as .might be calculated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the trade- mark sought to be registered; and that the specimens show the trade-mark as actually used upon the goods.
