To all whom it may conceww Be it known that we, TY-ON FROGK Co., a firm domiciled in Los Angeles, county of Los Angeles, State of California, doing business at 2604; West Adams Gardens, and composed of the following members; WINNIl`RED H. JOHNSON and ‘NELLTE L. H0\¥'LAND, citizens of the United States of America, have adopted and used the trade- mark shown in the accompanying drawing, for house-dresses, in Class 39, Clothing. TY-ON The trade mark has been continuously used in our business since July 12th, 1920. J OHNSON, being duly sworn, deposes and says: that she is a~ mem- ber of the firm, TY~ON FROGK Co., the ap- plicant for registration of a trade mark for house dresses, filed September 23, 1920, Serial Number 137 ,546; that she believes the statement Iiled with said application to be true; that she believes said firm to be the owner of the mark sought to be registered; that no other person, firm, corporation or association, to the best of her knowledge and belief, has the right to use said mark in the United States of America, on merchan- dise of the same descriptiveoproperties as those recited in the statement of said ap- plication; that said mark is used by said firm in commerce among the several States of the United States; that the description and drawing presented truly represent the mark sought to be registered; that the specimens show the mark as actually used upon the goods; and that the mark has been in bona flclc use for not less than one year in interstate commerce by the applicant or its predecessors in business. .
