A To all 'whom it may concern .' Be it known that the GANDOLFO-GHIO MFG. Co., a corporation duly created and ex- isting under and by virtue of the laws of the State of Missouri, and located and doing bus- iness at 818-820 North Ei hth street, in the city of St. Louis, in said State, has adopted and used the trade-mark shown in the accom- panying drawing, for spaghetti, macaroni, vermicelli, and noodles, in Class No. 46, Foods and ingredients of foods. The trade-mark has beencontinuously used in the business of said corporation since May 1, 1920. The trade-mark is usually applied to the goods by aiiixing to the boxes, cartons, or other packages containing the same' a. suit- able printed or lithographed label on which the trade-mark appears. WIBRACHT, being duly sworn, deposes and says that he is the president of the corporation, the applicant named in the foregoing statement; that he believes _ the foregoing statement is true; that he believes said corporation is the owner of 'the trade- mark sought to be registered; that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the trade-mark sought to be registered; and that the speci- mens show the trademark as actually used upon the goods.
