The trade-mark has been continuously used ‘v in the business of said corporation since De- cember 15, 1910. e The trade-mark is applied or aiiixedito the goods, or to the packages containing the same, by stamping or placing thereon a printed label on which the trade-mark is shown. HERZBERG, being duly sworn, deposes and says that he is the treasurer of the corporation, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said corporation to be the owner of the mark sought to be registered; that no other person, iirm, corporation, or asso- ciation, to the best of his knowledge and belief, has the right to use said mark in the United States of America, on merchan- dise of the same descriptive properties as those recited in the foregoing statement; that said mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the mark sought to be registered; that the specimens show the mark as actually used upon the goods; and that the mark has been in bona #cle use for not less than one year in inter- state or foreign commerce by the applicant or its predecessors in business.
