Serial No. 148,854. STATEMENT. Toi all whom it may concern: Be it known that THE ROTH COAL COM- PANY, INC., a corporation organized under the laws of the State of Tennessee, and hav- ing a principal place of business at 43 EX- change Place, in the city, county, and State of New York, has adopted for its use the trade-mark shown in the accompanying drawing. No claim is made to the representation of the goods appearing in the drawing apart from the mark as shown. The trade-mark has been continuously used in its business since January, 1921. The class of merchandise to which the trade-mark is appropriated is Class 1, Raw or partly-prepared materials, and the par- ticular description of goods comprised in said class upon which said trade-mark is used is coal. '_ The trade-mark is usually displayed by attaching labels on which the mark is shown to the cars containing the goods. _ THE ROTH COAL COMPANY, INC., By L. H. STONE, being duly sworn, deposes and says that he is the secretary and treas- urer of the corporation,'the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he be- lieves said corporation to be the owner of the trade-mark sought to be registered; that no other person, firm, corporation, or asso- ciation, to the best of his knowledge and belief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be calcu- lated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the drawing presented truly represents the trade-mark sought to be reg- istered; and that the specimens, or fac- similes show the trade-mark as actually used upon the goods. - L.
