STATEMENT. p To all whom it may cofncewt : Be it known that the RUBYHILL VCINEYARD Co., a copartnership composed of FRANK GARATTI and CHARLEs FERRARIO, citizens of the United States, located at Pleasanton, in the county of Alameda and State of Cali- fornia, and doing business at Pleasanton, California, has adopted for its use the trade-mark' shown in the accompanying drawing, for grape-juice containing less than of 1% alcohol, by volume, sold as a Ruby soft drink, in Class 45, Beverages, non-alco- holic. The trademark has been continuously used in the business of said company since J an- uary 21, 1921. The mark is applied or affixed to the goods or to the packages containing the same by placing thereon a printed wrapper or a printed label. A ~ State of California, county of Alameda, ss: FRANK GARATTI, being duly sworn, de- pose and says that he is one of the part- ners of the RUBYHILL VINEYARD Co., the ap- plicant named in the foregoing statement; that he believes that the foregoing* statement is true; that he believes said company to be the owner of the trade-mark sought to be registered; that no other person, firm, cor- poration, or association-, to the best of his knowledge and belief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be calculated, to deceive; that said trade-mark is used by it in commerce among the several States of the United States, and also between the United States and foreign nations, or Indian tribes; that the drawing presented truly represents the trade-mark sought to be registered; that the specimens show the trade-mark as actually used upon the goods.
