Application filed April 20, 1921. Serial No. 146,442. I STATEMENT. To all whom it may concerm' Be it known that THE LYON BOTANICAL Co. INC., a corporation duly organized un- der the laws of the State of Delaware, and located in the city of New York, borough of Manhattan, in the county and State of New York, and doing business at No. 35 Fulton Street, in the city, county, and State of New York, has adopted and used the trade-mark shown in the accompanying drawing, for insect powder, in Class No. 6, Chemicals, medicines, and pharmaceuticalpreparations. The trade mark has been continuously used in the business of said corporation since on or about January 15th, 1921. The mark is applied to the packages or containers of the goods by placing thereon a printed label on which the mark is shown, or by printing or stenciling the same directly upon such containers, or the cartons in which a number of said containers are packed. NIGKELLS, being duly sworn, deposes and says that he is the vice presi- dent of the corporation, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he be- lieves said corporation is the owner of the trade mark sought to be registered; that no other person, Hrm, corporation, or associa- tion, to the best of his knowledge and belief, has the right to use said trade mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the trade mark sought to be registered; and that the specimens show the trade mark as actually used upon the goods.
