THOMAS, a citizen of the United States of America, re- siding at Topeka, county of Shawnee, State of Kansas, and doing business at 514 Kansas Avenue, Topeka, Kansas, and at Kansas City, county of Jackson, State of Missouri, under the name THE NIAGARA AUTOMOTIVE SPECIALTIES COMPANY, have adopted and used the trade-mark shown in the accom- panying drawing, for water circulators, in ie? Class No. 23, Cutlery, machinery, and tools, and parts thereof. The trade-mark has been continuously used in my business since July first, 1919. The trade-mark is applied or affixed to the goods, and to the packages containing the same, by affixing to the goods a plate on which the trade-mark appears, and by plac- ing on the packages containing the goods a label on which the trade-mark is printed. FRANK S. THOMAS. DECLARATION. County of Shawnee, State of Kansas, FRANK S. THOMAS, being duly sworn, de- poses and says that he is the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he be- lieves himself to be the owner of the mark sought to be registered; that no other person, firm, corporation, or association, to the best of his knowledge and belief, has the right to use said mark in the United States of Amer- ica, on merchandise of the same descriptive properties as those recited in the foregoing statement: that the said mark has been used. by him in commerce among the several States of the United States; that the descrip- tion and drawing presented truly represent themark sought to be registered; that the specimens show the mark as actually used upon the goods; and that the mark been in bona fide use for not less than Ongéyear in interstate commerce by the applicant. .
