To all whom 1225 may concefms Be it known that we, PINKUS BROTHERS, a firm domiciled in the city, county, and State of New York, doing business at 91 Third Ave., in said city, and composed of FLORA VV. P1NKUs, a citizen of the United States of America, have adopted and used the trade-mark shown in the accompanying drawing, for cigarettes, in Class No. 17, To- bacco products. The trade-mark has been continuously used in our business since May, 1894. The trade-mark is applied or afiixed to the goods, or to the packages containing the same, by placing thereon a printed label on which the trade-mark is shown. PINKUS BROTHER-S, By FLORA W. PINKUS, being duly sworn, de- poses and says that she is a member of the firm, the applicant named in the foregoing statement; that she believes the foregoing statement is true; that she believes said firm is the owner of the trade-mark sought to be registered; that no other person, firm, cor- poration, or association, to the best of her knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near re- semblance thereto as might be calculated to deceive; that said trade-mark is used by said firm in commerce among the several States of the United States; that the description and drawing presented truly represent the trade-mark sought to be registered; that the specimens show the trade-mark as actually used upon the goods; and that the mark has been in actual use as at trade-mark of the applicant for ten years next preceding Feb- ruary 20, 1905, and that, to the best of her knowledge and belief, such use has been ex- clusive.
