BARBOUR COMPANY, a corporation created under and existing by virtue of the laws of the State of New Jer- sey, and having its principal place of busie- ness at Paterson, Passaic County, and State of New Jersey, has heretofore adopted and used the trade-mark shown in the accompany- ing drawing, for twine, in Class 7, Cordage. The trade-mark has been continuously used in applicant’s business and in the business of its predecessors since March, 1912. The trade-mark is applied or affixed to the goods by means of labels bearing this trade mark or by printing or impressing the same directly on the goods and in divers other J. E. MORGAN, being duly sworn, deposes and says he is the treasurer of J. E. BARBOUR COMPANY, the applicant named in the foregoing statement; that he believes that the foregoing statement is true; that he believes said corporation to be the owner of the trade=mark sought to be registered; that no other person, firm, corporation or associa- tion, to the best of his knowledge or belief, has a right to use said trade-mark, either in the identical form, or in any such near re- semblance thereto as might be calculated to deceive; that the said trade-mark is used by the applicant in commerce among the sev- eral States of the United States; that the drawing presented truly represents the trade-mark sought to be registered and that the specimens show the trade-mark as actu- ally used upon the goods; and that the mark has been in bona fide use for not less than one year in interstate commerce by the ap- plicant or its predecessors in business.
