A., a corporation duly organized under the laws of Spain, and located in the city of Madrid, Spain, and doing business at Calle de Granada 12, Madrid, Spain, has adopted and used the trade-mark shown in the ac- companying drawing, for a medicinal soap, in Class 4, Abrasive, detergent, and polish- ing materials. _ The trade-mark has been continuously used in the business of said corporation since Feb- ruary, 1916. BERENGUER, being duly sworn, deposes and says that he is the general manager of the corporation, the applicant named in the statement filed March 15, 1921, Serial Num- ber 144,785; that he believes the said state- ment is true; that he believes said corpora- tion is the owner of the trade-mark sought to be registered; that no other person, firm, cor- poration, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near re- semblance thereto as might be calculated to deceive; that said trade-mark has been regis- tered in Spain, on May 13th, 1916, Number 27660; that the said trade-mark has been in bona fide use in interstate commerce for a period of not less than one year; that the drawing presented truly represents the trade- mark sought to be registered, and that the specimens show the trade-mark as actually used uponthe goods f A.
