Registered Jan. 24, 1922. , Application iled January 4, 1921. Serial No. 141,8-14. STATEMENT. , To all whom it may conoewz: Be it known that we, HENRY W. PEABODY & Co., a firm domiciled in New York, county of New York, State of New York, doing business at No. 17 State Street, in said city, and composed of the following members, FREDERIC VVALKER LINCOLN, JOHN RICE BRADLEE, and EDWARD BARRY, citizens of the United States of America, have heretofore adopted and used the trade-mark shown in the accompanying drawing, for garnetlac- a grade of gum shellac-exclusive use of the word “ Pure ” being disclaimed apart from the mark as shown, in Class No. 1, Raw or partly-prepared materials. The trade-mark has been continuously used in its business since November, 1911. The trade-mark is applied or aiiixed to the container in which the goods are sold by means of a stencil, also by placing thereon a printed tag on which the trade mark is shown. HENRY W. PEABODY & Co. the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes -said lirm is the owner of the trade-mark sought to be registered; that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be cal- culated to deceive; that the said trade-mark is used by said firm in commerce among the several States of the United States; that the drawing presented truly represents the trade- mark sought to be registered, and that the specimens show the trade-mark as actually used upon the goods.
