NUTT, a cit- izen of the United States of America, re- siding in the city of Des Moines, county of Polk, State of Iowa, and doing business at No. 4803 Grand Avenue, in said city and State, have adopted and _used the trade- mark sho~wn in the accompanying drawing. The particular description of goods to which said trademark is appropriated is cathartic pills, in Class 6, Chemicals, medi- cines, and pharmaceutical preparations. The letters “ C. C.” do not form a part of the registration sought apart from the mark shown in the drawing. The trademark has been used con- tinuously in the business of the applicant since November 15, 1916. The trade-mark is applied or afiixed to the goods, or to the packages containing the same by placing the-reon printed labels upon which the trade-mark is shown. PAUL O. NUTT. NUTT being duly sworn deposes and says that he is the applicant named in the foregoing statement; that he verily believes that the foregoing statement is true ; that he believes he is the owner of the trade- mark sought to be registered, that no other person, firm, corporation or association to the best of his knowledge and belief has the right to use said trade-mark in the United States, either in the identical form or in such near resemblance thereto as might be calculated to deceive; that such trade- mark is used by the applicant in commerce among the several States of the United States and that the description and drawing presented truly represent the trade-mark sought to be registered and the specimen (or facsimiles) show the trade-mark as ac- tually used upon the goods.
