Be it known that ROGERS ‘CANDY & Ion CREABI Co., a corporation duly organized under the laws of the State of Washington and located in the city of Seattle, county of King, in said State, and doing business at No. 4339 14th N. E., in the city of Seattle, State of Washington, has adopted and used the trade-mark shown in the accompanying drawing, for candies, in Class No. 46, Foods and ingredients of foods. The surname “Rogers” and the descriptive word “Chocolates” are hereby disclaimed apart from the other features of the mark shown on the drawing. The trade-mark has been continuously used in the business of said corporation since July 15, 1920. The trade-mark is applied or aflixed to the goods, or to the packages containing the same, by placing thereon a printed label on which the trade-mark is shown. ROGERS CANDY & ICE CREAM C0. H. W. SOULES, being duly sworn, deposes and says that he is the president of the cor- poration, the applicant named in the fore- going statement; that he believes the fore- going statement is true; that he believes said corporation is the owner of the trade-mark sought to be registered; that no other person, firm, corporation, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto, as might be calcu- lated _to deceive 5 that said trade-mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the trade-mark sought to be regis- tered; and that the specimens show the trade-mark as actually used upon the oods.
