STATEMENT., , I To all 'whom it may concern: Be it known that the I{EEN ITOLA MANU- FAOTURING COMPANY, a corporation duly or- ganized under the laws of the State of Ok- lahoma, and located in Dallas, county of Dallas, State of Texas, and doing business at Ervay, at Coombs Street, Dallas, Texas, has adopted and used the trade-mark shown in the accompanying drawing, for a non- alcoholic, noncereal, maltless beverage sold as soft drinks, and sirups for making the same, in Class No. 45, Beverages, nonalco- holic. The trade-mark has been continuously used in the business of said corporation since January 1, 1918. The trade-mark is applied or afiixed to the goods, or to the packages containing the same, by placing thereon printed labels upon which the trade mark is shown. Bninsns, being duly sworn, de- poses and says that he is president of the corporation, the applicant named in the fore- going statement; that he believes the fore- going statement is true; that he believes said corporation is the owner of the trade-mark sought to be registered; that no other per- son, firm, corporation or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly represent the trade-mark sought to be registered; and that the speci- mens show the trade-mark as actually used upon the goods.
