To all whom it may cof/mem: Be it known that SPA BA'rHs Co., ING., a corporation duly organized under the laws of the Stateof New York, and located in the city of Saratoga Springs, coiuity of Saratoga, in said State, and doing business at No. 9 Woodlawn Avenue, in said city of Saratoga Springs, has adopted and used the trade-mark “Sel-Saratoga” shown in accom- panying drawing," for a mineral and medical salt, in Class No. 6 Chemicals medicines _ J _ 7 _ 1 and pharmaceutical preparations, no claim being made to the word “Saratoga” apart from the mark shown in the drawing. The trade-mark has been continuously used in the business of said corporation since June 1, 1921. The trade-mark is applied or aflixed to the goods or to the packages containing the same by placing or printing thereon a print- ed label on which the trade-mark is shown. DECLARATION. ‘ State of New York county of Albany ss: RANULF COMPTON, being duly sworn, de- poses and says that he is the secretary of the corporation, the SPA BATHS Co., ING., the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he believes said corporation is the owner of the trade-mark sought to be registered; that no other person, Erin, cor- poration orassociation, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the description and drawing presented truly rep- resent the trade-mark sought to be regis- tered; and that the specimens show the trade-mark as actually used upon the goods.
