To all whom it may concern .- Be it known that Dnvornn CANDY COM- PANY, a corporation duly organized under the laws of the State of New York, and with its principal ofiice located in the city of Bal- timore, in the State of Maryland, and doing business at the C'oca Cola Building, Balti- more, Maryland, has adopted and used the trade-mark shown in the accompanying drawing, for chocolate sirups and other maltless sirups used in connection with soft drinks and at soda fountains, in Class 45, Beverages, nonalcoholic. ' The trade-mark has been continuously used in the business of said corporation since May ia, 1920. CHARLES G. GUTH, being duly sworn, de- poseth and says: that he is president of the corporation, the applicant named in the fore- going statement; that he believes the fore- going statement is true; that he believes said corporation is the owner of the trade-mark sought to be registered; that no other per- son, firm, corporation, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto, as might be calculated to deceive; that said trade- mark is used by said corporation in com- merce; among the several States of the United States; that the description and drawings presented truly represent the trade-mark sought to be registered; and that the specimens show the trade-mark as actu- ally used upon the goods.
