'Application iled April 5, 1921. Serial No. 145/748. STATEMENT. ' To all 'wk-cfm. it may concern: Be it known that H. & E. CIGAR COMPANY, a partnership domiciled in the county of Lancaster and State of Pennsylvania, doing business near the city of Lancaster, in said county, the address of which is R. D. 6, Lan- caster, Penna., and which is composed of the followi ╗ members, OLIVER G. Hnss and FRANKnž{. EGHTERNAGH, citizens of the United States of America, has adopted and used the trade-mark shown -in the accom- panying drawing, for cigars, in Class 17, Tobacco products. The trade-mark has been continuously used in the business of said partnership since March 1, 1921. ' The trade-mark is applied or affixed to the goods, or to packages containing the same, by affixing thereto a printed label on which the trade-mark is shown, or by printing the trade-mark directly upon the container. Hass, being duly sworn, deposes and says that he is a member of the partner- ship, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that be believes said part- nership is the owner of the trade-mark sought to be registered; that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be cal- culated to deceive; that said trade-mark is used by said partnership in 'commerce among the several States of the United States; that the description and drawing presented 'truly represent the trade-mark sought to be reg- istered; and that the specimens show the trade-mark as actually used upon the goods..
