SCHRIVER Co., a corporation organized and existing under the laws of the State of Ohio, and doing business at 621 E. Pearl St., in the city of Cincinnati, county of Hamilton, State of Ohio, has adopted for its use the trade-mark shown in the accompanying drawing, no claim being made to the exclusive right in the word “ Fruit ” except in the connection shown, for use upon fruit presses, in Class 23, Cutlery, machinery, and tools, and parts thereof. 1 _ The trade-mark has been used continuously in the business of said corporation since May 17, 1921. ~ The trade-mark is applied by means of tranfers which are aflixed to the goods. E. F. HAPPENSACK, being first duly sworn, deposes and says that he is the secy.-treas- urer of the corporation, the applicant named in the foregoing statement; that he believes the foregoing statement is true; that he be- lieves said corporation is the owner of the trade-mark sought to be registered; that _no other person, firm, corporation or associa- tion, to the best of his knowledge and belief, has the right to use said mark in the United States, either in the identical form, or in any such near resemblance thereto as might be calculated to deceive; that said mark is used by applicant in commerce among the several States of the United States; that the description and drawing presented truly represent the mark sought to be registered; that the specimens show the mark as actu- ally used upon the goods.
