Act of 1946 Application July 5, 1947, Serial No. 527,401 »-~nq \'l \ Q ( *e"\\ lr ( Statement) Liberty Mutual Insurance Company, a corpora- tion duly organized under the laws of the Com- monwealth of Massachusetts, with principal of- fices at 175 Berkeley Street, Boston, Massachu- setts, has adopted and is using the service mark shown in the accompanying drawing, for INSUR- ANCE SERVICES DEALING WITH ACCIDENT, LIABILITY AND PROPERTY INSURANCE AND REINSURANCE, INCLUDING THE. FOL- LOWING KINDS OF INSURANCE: FIRE AND OTHER PROPERTY INSURANCE, GENERAL LIABILITY, WORKMEN’S COMPENSATION, AUTOMOBILE AND AIRCRAFT DAMAGE AND LIABILITY, DISABILITY, FIDELITY, SURETY, BURGLARY, FORGERY, AND WATER DAM- AGE, in Class 102, Insurance and iinancial and presents herewith five specimens showing the service mark as actually used in connection with such services; the service mark being used as follows: Upon the letterheads, sales and adver- tising material, insurance policies and other ma- terial of applicant, and the applicant requests that the same be registered in the United States Patent Office on the Principal Register in ac- cordance with the act of July 5, 1946. The lin- ing in the drawing represents lining in the mark and does not indicate color. The service mark was first used on February 15, 1945, and first used in the sale or advertis- ing of services rendered in commerce among the several States which lawfully may be regulated by Congress on the aforesaid date. Bruce Black, being duly sworn, deposes and says that he is the president of Liberty Mutual Insurance Company, the applicant named in the foregoing statement; that he believes that said corporation is the owner of the service mark which is in use in commerce among the several States; that no other person, firm, corporation or association, to the best of his knowledge and belief, except as stated below, has the right to use such service mark in commerce which may lawfully be regulated by Congress either in the identical form thereof or in such near resem- blance thereto as might be calculated to deceive; that United Mutual Fire Insurance Company, an associated corporation duly organized under the laws of the Commonwealth of Massachusetts with its principal oflices at 175 Berkeley Street, Boston, Massachusetts, is a, corporation which is related to applicant within the meaning of sec- tion 5 of the Trade-Mark Act of July 5, 1946, and useslthe same service mark; that the two com- panies have been closely associated since 1918 for the purpose of affording to their policy-ho1d- ers and claimants a unified and complete insur- ance service dealing with accident, liability and property insurance and reinsurance; that both companies are mutual insurance companies and in numerous respects have the same manage- ment legitimately controlling the nature and quality of the services rendered; that the draw- ing and description truly represent the service mark sought to be registered; that the specimens show the service mark as actually used in con- nection with services and that the facts set forth in the statement are true.
