Registered Jan. 10, 1950 Registration No. 519,783 PRINCIPAL REGISTER Service Mark UNITED STATES PATENT OFFICE National Trailways Bus System, Chicago, Ill. Act of 1946 Application October 23, 1947, Serial No. 538,061 (Statement) National Trailways Bus System, a voluntary organization, domiciled in Chicago, Illinois, doing business at 185 North Wabash Avenue, Chicago 1, Illinois, and composed of a number of member companies, has adopted, and it and its member companies are using, the service mark shown in the accompanying drawing, for PASSENGER MOTORBUS TRANSPORTATION SERVICE, in Class 105, Transportation and storage, and pre- sents herewith five (5) specimens showing the service mark as actually used in connection with the sale or advertising of such services; the serv- ice mark being used as follows: by being displayed on all buses operated by it or its member com- panies, or being displayed on all material and advertisements issued in connection with such services, by being either printed or painted there- on; and requests that the same be registered in the United States Patent Office on the Principal Register in accordance' with the act of July 5, 1946. The service mark was iirst used on March 19, 1943, and first used in the sale or advertising of services and the services rendered in commerce between the several States of the United States which may lawfully be regulated by Congress on March 19, 1943. The outline map of the United States and the words “Bus System” are disclaimed apart from the mark as shown. The applicant is the owner of Trade-Mark Registration No. 352,654, issued December 7, 1937 (National Trailways System). (Declaration) Fred H. McIntosh, being duly sworn, deposes and says that he is secretary of the voluntary or- ganization, the applicant named in the foregoing statement; that he believes said voluntary organ- ization is the owner of the service mark, which is in use in commerce between the several States of the United States and that no other person, firm, corporation or association, to the best of his-knowledge and belief, has the right to use such service mark in commerce which may lawfully be regulated by Congress either in the identical form thereof, or in such near resemblance there- to as might be calculated to deceive, except ap- p1icant’s member companies which are legiti- mately controlled by the applicant in respect to the nature and quality of the services in connec- tion with which the mark is used; that the draw- ing and description truly represent the service mark sought to be registered; that the specimens show the service mark as actually used in con- nection with the sale or advertising of services, and that the facts set forth in the statement are true.
