T-= ` ef _Vg _.. _ 7 , ., .M 1 l' 3) = (Statement) Niagara Fire Insurance Company, a corpora- tion duly organized under the laws of New York and located at New York, New York, and doing business at 80 Maiden Lane, city, county, and State of New York, has adopted and is using the service mark shown in the accompanying draw- ing (a sketch of Niagara Falls, which is fanci- ful and which is lined for shading purposes Only), for THE UNDERWRITING BY THE NIAGARA FIRE INSURANCE COMPANY OF THE FOL- LOWING CLASSES OF INSURANCE: FIRE IN- SURANCE; MISCELLANEOUS PROPERTY IN- SURANCE; WATER DAMAGE INSURANCE; COLLISION INSURANCE; MOTOR VEHICLE AND AIRCRAFT INSURANCE; MARINE' IN- SURANCE; MARINE PROTECTION AND IN- DEMNITY INSURANCE; REINSURANCE OF RISKS OF EVERY KIND OR DESCRIPTION, EXCEPT LIFE AND ANNUITIES; AND ON RISKS OUTSIDE OF THE UNITED STATES, ITS TERRITORIES AND POSSESSIONS, ALL KINDS OF INSURANCE, EXCEPT LIFE AND ANNUITIES, in Class 102, Insurance and finan- cial, and presents herewith iive (5) specimens showing the service mark as actually used in con- nection with the sale or advertising of such serv- ices; the service mark being used as follows: by imprinting facsimiles thereof on policies, sta- tionery and advertising matter, and requests that the same be registered in the United States Pat- ent Oflice on the Principal Register in accord- ance with the act of July 5, 1946. The service mark was iirst used January 26, 1886, and first used in the sale or advertising of services and the services rendered in commerce among the several States and in commerce be- tween foreign nations and the United States which may lawfully be regulated by Congress, January 26, 1886. Christensen, being duly sworn, deposes and says that he is the president of Niagara Fire Insurance Company, the applicant named in the foregoing statement, that he believes that said corporation is the owner of the service mark, which is in use in commerce among the several States and that no other person, Hrm, corpora- tion or association, to the best of his knowledge and belief, has the right to use such service mark in commerce which may lawfully be regulated by Congress either in the identical form thereof, or in such near resemblance thereto as might be calculated to deceive; that the drawing and de- scription truly represent the service mark sought to be registered; that the specimens (or fac- similes) show the service mark as actually used in connection with the sale or advertising of serv- ices, and that the facts set forth in the state- ment are true.
