Act of 1946 Application August 12, 1947, Serial No. 531,099 OURALUX (Statement) Chicago, Milwaukee, St. Paul and Pacific Rail- road Company, a corporation of Wisconsin, en- gaged in the business of interstate and intrastate freight and passenger transportation, having its principal oiiice and doing business at 516 West Jackson Boulevard, Chicago 6, Illinois, has adopted and is using the service mark shown in the accompanying drawing, for RAILWAY TRANSPORTATION OF PASSENGERS, in Class 105, Transportation and storage. And the applicant presents herewith five (5) specimens or facsimiles showing the service mark as actually used in 'connection with the sale or advertising of the services offered, sold, and fur- nished by the applicant; and requests that the same be registered in the United States Patent Oflice -on the Principal Register in accordance with the act of July 5, 1946. The service mark is applied to a variety of ad- vertising for the services, including advertise- ments in periodicals of national circulation, news- papers in general circulation, handbooks, bro- chures, time tables, folders and handbills distrib- uted to the public generally and to passengers. And the service mark has been, and is cur- rently being, so used in commerce. The said service mark was iirst used by the applicant on May 16, 1947, and first used in the sale or advertising of services rendered in inter- state commerce on June 29, 1947. (Declaration) J. W. Severs, being iirst duly sworn, deposes and says that he is a citizen of the United States of America and of the State of Illinois, residing in Evanston, Cook County, Illinois; that he is, and for twenty months last past has been, vice presi- dent and comptroller of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, the ap- plicant named in the foregoing statement; that he is familiar with the records of the applicant and its advertising together with its marks, sym- bols, names, and slogans used in said advertising; and that he believes the Chicago, Milwaukee, St. Paul and Pacific Railroad Company, the appli- cant named in the foregoing statement, is the owner of a certain service mark shown in the ac- companying drawing; that said service mark is in use in commerce among the several States; and that on other person, lirm, corporation or asso- ciation, to the best of his knowledge or belief, has the right to use the service mark in commerce which may lawfully be regulated by Congress either in the identical form thereof, or in such near resemblance thereto as might be calculated to deceive; that the accompanying drawing and description truly represent the service mark sought to be registered; that the accompanying specimens or facsimiles show the mark as actu- ally used in connection with the furnishing, sale or advertising of the services offered by the ap- plicant; that the service mark sought to be reg- istered is distinctive of the applicant’s services in commerce; and that the facts set forth in the statement are true.
