° O O Registered Mar. 14, 1950 Registration No. 522,433 PRINCIPAL REGISTER Service Mark UNITED STATES PATENT OFFICE Act of 1946 Application October 30, 1947, Serial No. 539,575 Z7Z@AlVL?l"[%VL7l$5"'1?’ (Statement) Arthur Stadler, a citizen of the United States, residing at 535 West 186th Street, New York city, and doing business at 139 East 57th Street, New York city, has adopted and is using the service mark shown in the accompanying drawing, for a TRAVEL SERVICE-NAMELY, (1) GENERAL ASSISTANCE TO THE CLIENT AS TO CHOICE OF A VACATION, CONSIDERING SUCH FAC- TORS AS BUDGET, AVAILABLE TIME, PER- SONAL DESIRES, PERSONALITY, ETC.; (2) RENDERING OF ADVICE AS TO TRAVEL CONDITIONS IN THIS COUNTRY AND ABROAD, INCLUDING SUCH ASPECTS OF TRAVEL AS TRANSPORTATION SCHEDULES, HOTEL FACILITIES, PASSPORT AND VISA REQUIREMENTS; (3) SECURING OF AIR- LINE, RAILROAD, AND STEAMSHIP TICK- ETS; (4) ARRANGING FOR HOTEL ACCOM- MODATIONS, SIGHTSEEING TOURS, THE LATTER THROUGH THE COOPERATION OF TRAVEL AGENTS IN OTHER CITIES; (5) OR- GANIZATION OF GUIDED GROUP AND INDE- PENDENT TOURS AND THE ISSUANCE OF ADVERTISING MEDIA DESCRIBING THE ITINERARY OF SUCH TOURS-in Class 105, Transportation and storage, and presents here- with five (5) specimens showing the service mark as actually used in connection with the sale or advertising of such services; the service mark being used as follows; advertising, stationery, and requests that the same be registered in the United States Patent Oiiice on the Principal Reg- ister in accordance with the act of July 5, 1946. The service mark was iirst used on March 22, 1946, and first used in the sale or advertising of services and the services rendered in commerce among the several States and in commerce be- tween foreign nations and the United States which may lawfully be regulated by Congress on April 1, 1946. The applicant disclaims exclusive right to the use of the word “Trave1,” recognizing it as being descriptive of the services 1‘endered. ( Declaration) Applicant, being duly sworn, deposes and says that he believes himself to be the owner of the service mark, which is in use in commerce among the several States and in commerce between foreign nations and the United States and that no other person, iirm, corporation or association, to the best of his knowledge and belief, has the right to use such se1'vice mark in commerce which may lawfully be regulated by Congress, either in the identical form thereof, or in such near resem- blance thereto as might be calculated to deceive; that the drawing and description truly represent the service mark sought to be registered; that the specimens show the service mark as actually used in connection with the sale or advertising of serv- ice, and that the facts set forth in the statement are true.
