Act of 1946 Application June 21, 1948, Serial No. 559,834 ( Statement) Continental Air Lines, Inc., a corporation duly organized under the laws of the State of Nevada, located at Denver, Colorado, and doing business at Stapleton Airlield, Denver 7, Colorado, has adopted, used and_ is using the service mark shown in the accompanying drawing, for AIR TRANS- PORTATION OF PASSENGERS AND CARGO, in Class 105, Transportation and storage, and presents herewith five facsimiles (photographs) showing the service mark as actually used in connection with the sale and advertising of such service; the service mark being used as follows: (1) painted on all airplanes; (2) printed in all advertising; and requests that the same be regis- tered in the United States Patent Office on the Principal Register in accordance with the act of July 5, 1946. ' ~ The service mark, “Skystreamer,” was first used on June 1, 1946, and first used in the sale of advertising of services and the service rendered in commerce among the several States which may be lawfully regulated by Congress on June 1, 1946. West, Jr., being duly sworn, deposes and says that he is the vice president of Continental Air Lines, Inc., the applicant named in the fore- going statement, that he believes that said cor- poration is the owner of the service mark, which is in use in commerce among the several States and that no other person, firm, corporation or association, to the best of his knowledge and be- lief, has the right to use such service mark in commerce which may lawfully be 1‘6gll13,t€d by Congress either in the identical form thereof, or in such near resemblance thereto as might be calculated to deceive; that the drawing and de- scription truly represent the service mark sought to be registered; that the facsimiles (photo- graphs) show the service mark as actually used in connection with the sale and advertising of services, and that the facts set forth in the state- ment are true.
