The service mark was iirst used on or about March 1, 1910, and iirst used in the sale or ad- vertising of services and the services rendered in commerce among the several States and in com- merce between foreign nations and the United States which may lawfully be regulated by Con- gress, on or about March 1, 1910. The applicant disclaims all right to the exclu- sive use of the words appearing in the service mark, except for the word “Phenix.” (Declaration) F. A. Christensen, being duly sworn, deposes and says that he is the president of Fidelity- Phenix Fire Insurance Company of New York, the applicant named in the foregoing statement, that he believes that said corporation is the owner of the service mark, which is in use in commerce among the several States and that no other per- son, firm, corporation or association, to the best of his knowledge and belief, has the right to use such service mark in commerce which may law- fully be regulated by Congress either in the iden- tical form thereof, or in such near resemblance thereto as might be calculated to deceive; that the drawing and description truly represent the service mark sought to be registered; that the specimens (or facsimiles) show the service mark as actually used in connection with the sale or advertising of services, and that the facts set forth in the statement are true.
