Act of 1946 Application January 7, 1948, Serial No. 546,375 EASTERN Jaffe# _ ( Statement) Eastern Air Lines, Inc., a corporation duly or- ganized under the laws of the State of Delaware, located at New York, New York, and doing busi- ness at 10 Rockefeller Plaza, New York 20, New York, has adopted and is using the service mark shown in the accompanying drawing, for AIR TRANSPORTATION OF PERSONS, PROP- ERTY, AND MAIL, in Class 105, Transportation and storage, and presents herewith five speci- mens showing the service mark as actually used in connection with the sale or advertising of such services, the service mark being painted, printed or otherwise applied on aircraft and other equip- ment, sign-boards, show-windows, sales counters, displays, buildings, timetables, advertising bro- chures and newspaper and magazine advertise- ments, or formed with electric lights and attached to or otherwise maintained on aircraft and other equipment, show-windows, sales counters, sign- boards or buildings; and requests that the same be registered in the United States Patent Office on the Principal Register in accordance with sec- tion 2(f) and other applicable provisions of the act of July 5, 1946. The service mark was irst used on May 16, 1934, and first used in the sale or advertising of services and the services rendered in commerce among the several States on May 16, 1934, and in commerce between the States and the Terri- tories of the United States on September 9, 1946. Applicant disclaims the words ďAir Lines.Ē (Declaration) T. F. Armstrong, being duly sworn, deposes and says that he is the secretary and treasurer of Eastern Air Lines, Inc., the applicant in the fore- going statement, and that he believes that said corporation is the owner of the service mark, which is in use in commerce among the several States and between the States and the Territories of the United States, and that no other person, iirm, corporation or association, to the best of his knowledge and belief, has the right to use such service mark in commerce which may law- fully be regulated by Congress either in the iden- tical form thereof, or in such near resemblance thereto as might be calculated to deceive, that the drawing and description truly represent the service mark sought to be registered, that the accompanying specimens show the service mark as actually used in connection with the sale or advertising of the services, that the service mark has become distinctive of app1icantís services in commerce, that app1icantís use of the service mark in commerce has been exclusive and con- tinuous for more than five years next preceding the date of this application, and that the facts set forth in the statement are true.
