Registered June 13, 1950 Registration No. 526,395 PRINCIPAL REGISTER Service Mark UNITED STATES PATENT OFFICE Act of 1946 Application September 2, 1947, Serial No. 533,009 Stag” 'N TTI- . _'ff.l Q; 4=f e i Q ‘Edi e 5 1 8 - 3°- _ 4 9 (Statement) The Detroit Bank, a corporation duly organized under the laws of the State of Michigan, located at Detroit, Wayne County, Michigan, and doing business at 46 State Street, has adopted and is using the service mark shown in the accom- panying drawing, for COMMERCIAL AND SAVING BANKING-NAMELY, DEPOSITORY, LOANS, MORTGAGES, DRAFTS, CHECKS, COLLECTIONS, ESCROW AND FISCAL AGENT, LETTERS OF CREDIT; AGENT FOR THE SALE, PURCHASE, AND DELIVERY OF SECURITIES; SAFE DEPOSIT BOXES, SE- CURITIES SAFEKEEPING, AND MISCEL- LANEOUS BANKING SERVICES-in Class 102, Insurance and financial, and presents herewith specimens showing the service mark as actually used in connection with the sale or advertising of such services; the service mark being used as follows: On various types of forms, advertising material, letterheads, checks, drafts, etc., and requests that the same be registered in the United States Patent Oiiice on the Principal Register in accordance with the act of July 5, 1946. The words “Oldest Bank in Michigan” and the date “1849” are disclaimed apart from the mark. ' The service mark was first used on or about March 1, 1912, and first used in the sale or adver- tising of services and the services rendered in commerce among the several States which may lawfully be regulated by Congress on or about March 1, 1912. The representation of the Indian in the drawing is fanciful. (Declaration) Clifford H. Hyett, being duly sworn, deposes and says that he is the Vice president and cashier of The Detroit Bank, the applicant named in the foregoing statement, that he believes that said corporation is the owner of the service mark, which is in use in commerce among the several States and that no other person, iirm, corporation or association, to the best of his knowledge and belief, has the right to use such service mark in commerce which may lawfully be regulated by Congress either in the identical form thereof, or in such near resemblance thereto as might be calculated to deceive; that the drawing and description truly represent the service mark sought to be registered; that the specimens show the service mark as actually used in connection with the sale or advertising of services, and that the facts set forth in the statement are true.
