Act of 1946 Application October 24, 1947, Serial No. 538,935 (Statement) Foss Launch & Tug Co., a corporation duly organized and existing under the laws of the State of Washington, located and doing business at 225 East F Street, in the city of Tacoma, county of Pierce, and State of Washington, has adopted and used the service mark shown in the accompanying drawing, for TUG AND BARGE SERVICE, in Class 105, Transportation and storage, and presents herewith iive specimens (or facsimiles) showing the service mark as actual- ly used in connection with the sale and/or adver- tising of such services, the service mark being used as follows: by painting on the stacks of the tugs and barges, and printing on letterheads, and in newspaper advertisements and requests that the same be registered in the United States Patent Oiiice on the Principal Register in ac- cordance With section 2(f) of the act of July 5, 1946. The claim of distinctiveness is based on sub- stantially exclusive and continuous use of the mark in commerce which may be regulated by Congress for the iive years next preceding the filing of the application and also upon additional evidence submitted separately in this case. The service mark was first used on January 2, 1917, and fl]fS'G used in the sale and/or adver- tising of services and the services rendered in commerce among the several States which may lawfully be regulated by Congress -in 1941. Ap- plicant is owner of Reg. No. 147,849 dated Nov. 1, 1921, EAU (Declaration) I-I. O. Foss, being duly sworn, deposes and says he is secretary of the applicant named in the foregoing statement; that he believes said corporation to be the owner of the service mark, which is in use in commerce among the several States, and that said service mark has been in substantially exclusive and continuous use in commerce which may lawfully be regulated by Congress for the period of iive years next preced- ing the “filing of this application; that said service mark has become distinctive of applicant’s services in commerce, and that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use such service mark in commerce which may law- fully be regulated by Congress, either in the identical form thereof or in such near resem- blance thereto as might be calculated to deceive, that the drawing and description truly represent the service mark sought to be registered, that the specimens (or facsimiles) show the service mark as actually used in connection with the services, and that the facts set forth in the state- ment are true.
