Act of 1946 Application February 5, 1948, Serial No. 548,785 lla() S S Sentinel Service ( Statement) The Baltimore & Ohio Railroad Company, a corporation duly organized under the laws of the State of Maryland and located at 2 North Charles Street, Baltimore, Maryland, and doing business at 2 North Charles Street, Baltimore, Maryland, has adopted and is using the service mark shown in the accompanying drawing, for RAILROAD TRANSPORTATION, in Class 105, Transporta- tion and storage, and presents herewith 'iive spec- imens showing the service mark as actually used in connection with the sale or advertising of such services; the service mark being used as follows: The mark is used by printing the same upon pub- lications, such as periodicals, advertising, both independently of and in periodicals, and in pamphlets, and by printing the same upon roll- ing stock, and requests that the same be regis- tered in the United States Patent Odice on the Principal Register in accordance with the act of July 5, 1946. The service mark was first used on December 1, 1946, and first used in the sale or advertising of services and the services rendered in commerce among the several States, which may lawfully be regulated by Congress on or about March 1, 1947. No claim is made to color but applicant reserves its rights at common law. (Declaration) Howard E. Simpson, being duly sworn, de- poses and says that he is the vice-president- Traiiic of The Baltimore & Ohio Railroad Com- pany, the applicant named in the foregoing statement, that he believes that said corporation is the owner of the service mark which is in use in commerce among the several States, and that no other person, firm, corporation, or associa- tion, to the best of his knowledge and belief, has the right to use such service mark in com- merce which may lawfully be regulated by Con- gress either in the identical form thereof, or in such near resemblance thereto as might be cal- culated to deceive; that the drawing and de- scription truly represent the service mark sought to be registered; that the specimens show the service mark as actually used in connection with the sale or advertising of services, and that the facts set forth in the statement are true.
