Donovan, all citizens of the United States of America, residing respec- tively at 2052 Lincoln Park West, Chicago, Illi- nois; 6139 Wofford Street, Dallas, Texas; and 6135 Wofford Street, Dallas, Texas, and doing business at Dallas, Texas, has adopted and is us- ing the service mark shown in the accompanying drawing, for POOL CAR DISTRIBUTION, UN- LOADING AND CHECKING OF SHIPMENTS, CUSTOMER PICK-UP, RESHIPPING, CAR LOADING, INDUSTRIAL HAULING, FUR- NISHING AND PREPARING BILLS OF LAD- ING, MARKING AND/OR TAGGING SHIP- MENTS, AND GENERAL FREIGHT AND MER- CHANDISE HANDLING OPERATIONS, in Class 105, Transportation and storage, and presents herewith ilve (5) specimens showing the service mark as actually used in connection with the sale and advertising of such services; the service mark being used as follows: 1. As a designation upon the partnership trucks, freight handling equipment, and on diverse ones of its properties, both real and personal, 2. As a designation in conjunction with its ad- vertising, letterheads, folders, cards, etc., 3. As a designation on its literature, commu- nications, and media of correspondence, and requests that the same be registered in the United States Patent Omce on the Supplemental Register in accordance with the act of July 5, 1948. ` The mark was nrst used on April 1, 1947, and iirst used in interstate commerce among the sev- eral States which may be lawfully regulated by Congress on April 1, 1947, and has been in lawful use and advertising of and in conjunction with the performance of services rendered in interstate commerce among the several States for the year preceding the filing of this Supplementary Regis- ter application. Williamson, being duly sworn, de- poses and says that he is a member of the firm of Texas Express Company, the applicant in the above identified application to register the service mark “Texas Express Company” Serial No. 529,112, that he believes that said firm is the owner of the service mark which is in use in com- merce among the several States which may be lawfully regulated by Congress, and that no other person, firm, corporation or association, to the best of his knowledge and belief, has the right to use such service mark in commerce which may be lawfully regulated by Congress, either in the identical form thereof or in such near resem- blance thereto as might be calculated to deceive, that the drawing and description truly represent the service mark sought to be registered, that the specimens show the service mark as actually used in connection with the services, and that the facts as set forth in the statement are true.
