Co., a corporation duly organized under the laws of the State of Nebraska, and located in the city of Omaha, county of Douglas, in said State, and doing business at No. 1212 Farnam street, in the city of Omaha, State of Nebraska, has adopted for its use the trade-mark shown in the accompanying draw- ing, for non-alcoholic tonic beverages ,and tablets and powders for making same, in Class No. 45, Beverages, non-alcoholic. The trade-mark has been continuously used in the business of said corporation since July lst, 1909. 'The trade-mark is applied or affixed to the goods, or to the packages containing the same, by placing thereon a printed label on which the trade-mark is shown. [iL.s.] LEO GROTTE MFG. Luo GROTTE, being duly sworn, deposes and says that he is the president of the cor- poration, the applicant named in the forego- ing statement ; that he believes the foregoing statement is true; that he believes said cor- poration to be the owner of the trade-mark sought to be_ registered; that no other per- son, firm, corporation, or association, to the best of his knowledge and belief, has the right to use said trade-mark in the United States, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark I 1 n 1 i is used by said corporation in commerce among the several States of the Uiiited States; that the specimens show the trade- mark as actually used upon the goods; and that the drawing presented truly represents the trade-mark sought to be registered.
