STATEMENT- ' To all whom 'lt may concern' ` Be it known that INDIANAPOLIS BRENVING Co., a corporation created under and exist- ing by virtue ofthe laws of the State of In- diana, and located and having its principal place of business at Indianapolis, in the county of Marion and State of Indiana, has adopted for its use the trade-mark shown in the accompanying drawing, for beer, in Class 48, Malt extracts and liquors. The trade mark has been continuously used in the business of said corporation since the lst day of January, 1910. The trade mark is applied or affixed to the goods, or to the packages containing the same, by placing thereon a printed label on which the trade-mark is shown. DECLARATION- State of Indiana, county of Marion. ss: ALBERT LIEBER, being duly sworn, deposes and says that he is president of the corpora- tion, the applicant named in the statement accompanying the above-entitled applica- tion; that he believes said statement_is true; that he believes said corporation to be the owner of the trade-mark sought to be reg- istered; that no other person, firm, corpora- tion, or association, to the best -of his knowl- edge and belief, has the right to use said trade-mark, either in the identical form or in any such near resemblance thereto as might be calculated to deceive; that said trade-mark is used by said corporation in commerce among the several States of the United States; that the specimens show the trade-mark as actually used upon the goods; and that the drawing presented truly repre- sents the trade-mark sought to be registered.
